TERMS AND CONDITIONS INDIVIDUAL BOOKING
2017
Guarantee to Operate
Sailing is only guaranteed with a minimum 6 (six) adult passengers. We will notify the agent 60 days prior to departure. If we do not have the minimum 6 (six) adult passengers, we will refund any payments made in full. Further claims against Sea Safari Cruises will not be entertained.
Fuel Surcharge
Sea Safari Cruises will only apply the US $30 surcharge per night per person if the cost of fuel increases substantially.
Reservation
All reservations must be made by electronic mail or facsimile and must state your agent, the cruise period, full name, date of birth, nationality, passport number, and any special requirements.
Deposit
A deposit of 20% must be paid within 10 days after the date the reservation is made. If the deposit is not received within the stated period of time then it will automatically offer the berths to other travel and booking agents. 20 % deposit is Non-Refundable.
Second Payment
The Second Payment, after the deposit a further thirty percent (30%) of the total invoice must be paid one hundred and eighty (180) days prior to the date of departure.
Balance Payment
Balance payment fifty percent (50%) is to be paid in full at least 60 days prior departure date. If full payment of the balance is not received by this date then Sea SafariCruises can cancel the booking and enforce cancellation fee.
Short Notice Booking
Full payment require, if the reservation is made less than 60 days prior to departure.
Late Payment Penalty Policy
For payment received after due date, the outstanding balance will automatically incur a penalty of 5%.
After the Late Payment Penalty is applied and if Sea Safari Cruises does not receive the payment within 30 days then Sea Safari Cruises will automatically cancel the booking and offer the berths to other travel and booking agents.
*Sea Safari Cruises will receive the NETT amount as stated on the invoice
Payment Terms and Condition:
– Payment by Rupiah (IDR) must check and follow http://www.bi.go.id/en/moneter/informasi-kurs/transaksi-bi/Default.aspx exchange rate before the
payment made.
– For transfer fee/admin fee should be paid by the customer.
– All the customers must follow ‘Sea Safari Cruises’ terms and conditions for all the transaction.
Cancellation Policy:
The following cancellation penalties apply unless amended by agreed local conditions:
91 – 179 days : 35% of the total invoice
46 – 90 days : 50% of the total invoice
0 – 45 days : 100% of the total invoice
Payment Onboard
Visa/ Master Card is acceptable as payment onboard for your bar bill, banana boat/ additional water activity and souvenirs. We rely on local internet connections for this service, so we advise you to bring cash in IDR or US$ just in case.
DIVING
To partake in any scuba diving activity with Sea Safari Cruises, we will require that you as the customer hold a certification from a recognised scuba diving agency such as SSI, CMAS, NAUI and PADI or similar. It is the client’s responsibility, as a certified diver, to respect and follow the guidelines given by the Sea Safari Cruises guides, instructors and cruise director plus to follow the regulations stipulated by their certification agency. Clients are solely responsible to provide a certification card and log book. Ignoring the directions given by the guides, or not presenting certification card, log book may cause a limitation or disqualification from scuba diving on the voyage. The diver accepts their responsibility to be technically capable and physically able to participate in the activity of scuba diving and fully accepts the risks associated. We reserve the right, for safety reasons, and at the discretion of the Sea Safari Cruises guides, instructors and cruise director to refuse access to one / several / all dives if they do not have the necessary competence to participate safely or if the dive is considered beyond their current level of diving. ie strong currents etc
All divers must either have Open Water with at least 30 logged dives in the past 5 years. All divers must produce a written/stamped logbook with your last dives and all necessary certification cards for the type of dives they wish to undertake. Dive insurance details MUST be provided on arrival.
EAN Nitrox 32% will only be available to divers who are certified in this speciality.
FORCE MAJEURE AND UNPREDICTABLE ACTS OF MAN
Sea Safari Cruises reserves the right to cancel a trip for reasons of Force Majeure (i.e. natural disaster, epidemic etc) or unavoidable acts of man (i.e. war, riots, strikes etc). In the even of this happening Sea Safari Cruises will advice you at the earliest possible date.
DAMAGES RESULTING FROM PERSONAL INJURY, ILLNESS OR DEATH
Sea Safari Cruises assumes no liability due to any cause whatsoever whether caused by failure or delay or other irregularity, acts or omissions occurring during a trip under which the means of transportation or other service provided thereby is offered or supplied by owners, operators or public carriers for and on behalf of Sea Safari Cruises.
Sea Safari Cruises shall not be responsible for any injury to person (whether or not resulting in death) or damage to property arising out of any act of war, insurrection, revolt or any other civil uprising or military action occurring in the countries of origin, destination or passage.
In case of a medical problem arising during the voyage, either onboard or on shore, which results in costs for evacuation, use of aircraft or repatriation, the responsibility for payment of these costs belongs solely to the passengers. We recommend you have DAN insurance for all diving activities.
LOSS OR DAMAGE TO PERSONAL BELONGINGS
Sea Safari Cruises does not take any responsibility for loss or damage to guest’s personal belongings that are due to Force Majeure causes. We recommend you have FULL travel insurance to protect your expensive belongings.
GENERAL AND OTHER CONDITIONS
Sea Safari Cruises reserves the right to substitute a vessel of similar standards when operational requirements demand.
Itineraries are subject to change due to sea and weather conditions, availability of sea anchorage, government regulations and other factors.
This contract is a CONFIDENTIAL agreement represented by the signatures attached and as such may not be communicated in any form, written or verbal, to third parties.
Any amendments and additions to the present contract shall be valid only when they are made in written form and duly signed by both parties.
This contract has no validity unless duly signed and returned to us as an acceptance of all rates and conditions
In any condition like economic situation of Indonesia especially for the significant increase of fuel, taxes, currency fluctuation and any other related factors, Sea Safari Cruises reserve the right increase the price even after the contract has been drawn.

TERMS AND CONDITIONS CHARTER BOOKING

In addition to our published cruise program, Sea Safari boats can be chartered to accommodate the route or itinerary of your preferences. However charter must confirm to the existing Sea Safari programs departure and arrival dates and ports. Charter request must be made by confirmed booking 90 days in advance.

Schedule and Itineraries
All schedule cruises can be booked as full-boat charters.
There are certain changes to the scheduled itineraries allowed by chartering customer subject to prior arrangement and approval by Sea Safari Cruises.

Entrance Fee to National Park
Since August 12, 2007 our waters have been declared the most bio diverse in the world and have been given the status of National Park and Marine Protected Areas. All divers are now required by the government regulation to pay an entrance fee to dive these areas. The ticket will be valid of one year and will go towards supporting reef conservation and community development. This project will be managed by three major NGOs, Coral International (www.coral.org), WWF (www.wwf.org) and TNC (www.nature.org). Sea Safari Cruises will pre-purchase the ticket for you and bill it to your account on board.
